TERMS & CONDITIONS
CONDITIONS OF SALE
1. Every person whilst on the premises before, during, or after the sale shall be deemed to be there at his own risk, and no person shall make or have any claim against the Auctioneers in respect of any injury he may sustain, or accident which may happen.
2. The Auctioneers act as agents only. Each lot as set out in the catalogue, or as divided or joined with any lot or lots at the sole discretion of the Auctioneers, is sold with all faults, imperfections and errors of description and the lots shall be at the purchaser’s risk immediately once they are sold. The Auctioneers are not responsible for the authenticity, attribution, genuineness, origin, authorship, date, age, period, condition or quality of any lot. All statements in the catalogue as to any of such matters are statements of opinion and are not to be taken as, or as implying, statements or representation of fact. Purchasers are deemed to have satisfied themselves by inspection or otherwise as to all such matters and as to the physical description of any lot. The Auctioneers, nor any person in the employment of the Auctioneers shall not make or give any representation or warranty, and in any event the Auctioneers are not responsible for any representation or warranty or for any statement in the catalogue.
3. The highest bidder acceptable to the Auctioneer, subject to reserve and Auctioneer’s discretion, shall be the buyer. The advance in the biddings is to be regulated by the Auctioneers, who are to be sole arbiters in any matter of dispute, and no person is to retract a bidding. The Auctioneers reserve the right to themselves of withdrawing from, consolidating or dividing any lot or lots, of varying the order of sale, or of accepting or refusing the bidding of any person as they may think fit.
4. Any items damaged or broken either accidentally or otherwise during viewing days or auction days must be paid for at the valuation set by the Auctioneer.
5. The Auctioneers will, on the buyer’s written instructions, execute bids on the buyer’s behalf, but neither the Auctioneer, nor the Auctioneer’s employees or agents, shall be liable for any neglect in doing so or in failing to do so.
6. The Auctioneer does not supply “Condition Reports”. The Auctioneers offer photographs via e-mail to enable the buyer to make an evaluation of a lot, but do not have the equipment to study restoration techniques or concealed damage and so can only relay what can be seen by the naked eye. If the buyer requires to know the detailed condition of a lot, it is vital that he views it himself, or delegates a suitably experienced person to do it for him. If a lot has (A/F) in the description, this means that the item may be damaged or repaired. However, please note that some items may be damaged or repaired but it has not been noticed by the auctioneers. Therefore it is advised that all items are thoroughly checked by the buyer or a deligated, experienced, person before making a commitment to buy.
7. If items that have been catalogued are withdrawn by the vendor prior to any auction, a charge of 10% of the reserve or lower estimate shall be made to cover administration costs, and a lottage fee of £2.00 per lot shall be levied.
8. By undertaking to buy or sell through Bentley's it is understood that buyers and vendors have read and agree to be bound by the company terms and conditions as stated.
PAYMENT
1. ALL ITEMS PURCHASED MUST BE PAID FOR PREFERABLY ON THE DAY OF THE SALE, OR, IF NOT, BY CLOSE OF BUSINESS ON THE WEDNESDAY IMMEDIATELY FOLLOWING THE SALE. BENTLEY'S RESERVE THE RIGHT TO CHARGE UP TO 1% INTEREST PER WEEK ON THE FULL AMOUNT OWED, ON PAYMENTS MADE AFTER THIS.
2. Cash – sterling only.
3. Cheques - Buyers paying by cheque must be prepared for the cheque to clear before taking possession of the goods purchased.
4. Debit card/Credit card is acceptable. Please note, however, that there is a surcharge of 3% on all Credit card transactions.
5. Banker’s draft is acceptable
6. Payments to vendors are issued 21 days after the auction, but may be delayed if full payment has not been received from the buyer.
CLEARANCE
1. Subject to satisfactory payment, all purchased items should be removed by the Friday immediately following the sale. In exceptional circumstances, and by prior arrangement only, items can be collected on the Saturday following the auction, between 09:30 and 10:30. All items remaining on the premises after this time shall be removed and Bentleys reserve the right to charge storage fees from £1.00 per lot per day.
2. All unsold items must be removed from the premises by the 20th of the month of the auction (unless the Auctioneer has agreed to re-enter the item). After this time, items will be moved to storage and fees as in (1) above levied. Please note that items with no reserve may be re-entered at the auctioneer's discretion.
